This privacy policy establishes the use of “Fichap Mobile”, “Fichap Point”, “Partner Portal” and “Fichap Dashboard” and “Fichap Website”, created and maintained by Workode SAS (the “Company” and/or “Fichap”). We are committed to safeguarding the privacy of visitors to our website, desktop and mobile applications. This policy details how we treat your personal information.
What should you know about how we treat your information?
Users and visitors undertake to browse the Website and to use the content in good faith. We inform you that:
1. The data you provide on the Website will be treated with the utmost confidentiality and will become part of the Database owned by the Owner and/or Administrator Users. The Owner User and/or Administrator User are solely responsible for the database, its custody and its registration, and must comply with applicable legislation on the protection of personal data. It is clarified that the Company only provides these users with a space to store and manage data and their human resources. All data that are addressed to the Company, as a recipient, will be stored in the database owned by Workode S.A.S. with address at Avenida Dorrego 2292, 2nd floor, office “B”, Autonomous City of Buenos Aires, Argentina, for the purposes detailed below.
2. You have no obligation to provide your personal data, unless you want to use the services of the Website or mobile applications, since they are essential for your individualization.
3. The use of the Service implies the acceptance of this privacy policy, as well as the authorization for the Company to process the personal data you provide to us.
4. You are entitled to exercise your rights of access, rectification and deletion of your personal data. For this purpose, if you are a Collaborating User, you may request it from your employer and if you are an Owner User or Administrator, you can do so from your profile on the Website. By merely visiting the Website, people who access it do not provide any personal information nor are they obliged to provide it. The Company presumes that the data have been entered by the owner or by a person authorized by him, and that they are correct and accurate.
What information do we collect?
- Information about your computer and mobile device, and about your visits and use including your IP address, geographical location, browser type, operating system, reference source to the site and app, duration of sessions and other data that is of interest to improve our service.
- Information that you provide us for the purpose of registering on our website and app, including email, first name, last name, place and country of residence, address, telephone number, avatar, photograph of your face and password to access the site.
- Any other information that you choose to send to Fichap.
Facial Data Collection
At Fichap, we value the privacy and security of our users. We use facial data exclusively for identity authentication purposes. This process involves:
- Facial Data Collection: During authentication, the application captures a facial image of the user, which is compared to a pre-existing profile photo provided by the user's company to verify the identity.
- Use and Processing: The captured facial image is used only for this validation purpose and is not used for any other purpose. The validation is performed using an algorithm that calculates the coincidence percentage without storing additional facial data.
- Storage and Retention: We do not store facial data after the authentication process. Facial images are processed in real time and discarded immediately after validation.
- Data Sharing: We do not share facial data with third parties. Our policy guarantees the confidentiality and privacy of our users' information.
- Security and Data Protection: We implement security measures to protect data processed during identity authentication, ensuring that it is handled securely and in accordance with applicable privacy laws.
Using your personal data
The personal data entered both on this website and in the mobile app will be used for the purposes specified in these privacy policies or in the sections that are required. We may use your personal information to:
- Administer the website and the app.
- Improve your browsing experience.
- Enable it to use the available services.
- Send you general commercial communications.
- Send you email notifications specifically requested by you.
- Send you our newsletter and other communications related to Fichap that we think will be of interest to you, where you specifically accepted this, by email. You can inform us at any time if you do not want to receive commercial communications. You can optionally modify your preferences in your account settings under the option 'Receive Newsletters', or click on the 'Unsubscribe' link below in the service's emails to unsubscribe from the newsletter.
- Provide third parties (including other Fichap users) with statistical information about users, this information will not be used to identify any particular individual.
- Deal with inquiries and complaints by or about you related to the website.
- Enable Collaborating Users to use the services in a faster and more accurate way, through the use of a photograph of their face. This image will be used to allow the system to recognize you, grant you access and link you to your profile. In this regard, the Collaborating User grants their express consent for the use of their image and the data that individualizes it. It is clarified that the data will only be stored for that purpose.
Without your express consent, we will not provide your personal information to any third party for direct marketing purposes. If you place an order with online payment, at no time does Fichap store your credit card details; this task is performed by online payment providers such as “Mercado Pago” and/or “Pay Pal”.
Data visibility
User data will only be visible in the Administration Dashboard by the organization that contracts the service by the person it assigns. This organization will only be able to access users and their respective data, which are under its responsibility.

We must disclose information about you to any of our employees, agents, as long as reasonably necessary for the purposes set out in this privacy policy. In addition, we must disclose information about you:
- To the extent that we are required to do so by law.
- In connection with any legal proceeding or possible legal proceeding.
- To establish, exercise or defend our legal rights (including providing information to others for fraud prevention purposes).

How to Exercise Your Rights of Access, Rectification, Cancellation and Opposition?
It is up to both Owner Users and Administrator Users to manage and keep User data up to date. The Owners and/or Administrative Users will have the right to access, rectify and delete Personal Data linked to their Organization, and may make changes to the data of Collaborating Users. To exercise this right, both Owner Users and Administrative Users must enter their User using their registered ID and Access Key, and enter “Company Data”, then 'Edit Profile', and then modify or delete the data they want. Meanwhile, to make changes to the data of Collaborating Users, Owner Users and Collaborating Users must enter “Collaborators”, select the Collaborating User, and then “edit”. Therefore, the Owner User as well as the Administrator User are responsible for the veracity and accuracy of the data and WORKODE S.A.S. will not be responsible for the inaccuracy of the Users' Personal Data. Users are informed that the deletion of any data may result in the blocking of the account or that the User cannot use the Service properly, the User assuming such risk and responsibility.
