Introduction
This privacy policy governs the use of “Fichap Mobile”, “Fichap Point”, “Portal del Colaborador” (Employee Portal), “Fichap Dashboard” and the “Fichap Website”, created and maintained by Workode S.A.S. (the “Company” and/or “Fichap”). We are committed to safeguarding the privacy of visitors to our website and users of our desktop and mobile applications. This policy explains how we process your personal information.
What should you know about how we process your information?
Users and visitors agree to browse the Website and use its contents in good faith. We inform you that:
The data you provide on the Website will be treated with the utmost confidentiality and will become part of the Database owned by the Owner Users and/or Administrator Users. The Owner User and/or Administrator User are solely responsible for the database, its safekeeping and its registration, and must comply with the applicable legislation on personal data protection. The Company merely provides these users with a space to store and manage data and their human resources. All data that is addressed to the Company, in its capacity as data recipient, will be stored in the database owned by Workode S.A.S., with registered address at Avenida Dorrego 2292, 2nd floor, office “B”, Ciudad Autónoma de Buenos Aires, Argentina, for the purposes described below.
You are not obliged to provide your personal data unless you wish to use the services of the Website or the mobile applications, since such data is essential for your identification.
Use of the Service implies acceptance of this privacy policy, as well as authorization for the Company to process the personal data you provide to us.
You are entitled to exercise your rights of access, rectification and erasure of your personal data. If you are a Collaborator User, you may request this from your employer, and if you are an Owner User or Administrator User, you may do so from your profile on the Website.
By merely visiting the Website, the persons accessing it do not provide any personal information nor are they obliged to provide it. The Company presumes that the data has been entered by its owner or by a person authorized by the owner, and that it is correct and accurate.
What information do we collect?
- Information about your computer and mobile device, and about your visits and use of the Website and apps, including your IP address, geographic location, browser type, operating system, referral source to the site and app, session duration and any other data that may be relevant to improving our service.
- Information you provide to us for the purpose of registering on our website and app, including email address, first name, last name, place and country of residence, address, phone number, avatar, photograph of your face and password to access the site.
- Any other information you choose to send to Fichap.
Facial data collection
At Fichap, we value the privacy and security of our users. We use facial data exclusively for identity authentication purposes. This process involves:
- Collection of Facial Data: During authentication, the application captures a facial image of the user, which is compared against a pre-existing profile photo provided by the user’s company in order to verify the user’s identity.
- Use and Processing: The facial image captured is used solely for this validation purpose and is not used for any other purpose. Validation is performed by an algorithm that calculates the match percentage without storing additional facial data.
- Storage and Retention: We do not store facial data after the authentication process. Facial images are processed in real time and discarded immediately after validation.
- Data Sharing: We do not share facial data with third parties. Our policy guarantees the confidentiality and privacy of our users’ information.
- Security and Data Protection: We implement security measures to protect the data processed during identity authentication, ensuring it is handled securely and in accordance with applicable privacy laws.
Use of your personal data
The personal data entered both on this website and in the mobile app will be used for the purposes specified in this privacy policy or in the relevant sections. We may use your personal information to:
- Administer the website and the app.
- Improve your browsing experience.
- Enable you to use the services made available.
- Send you general commercial communications.
- Send you email notifications that you specifically request.
- Send you our newsletter and other Fichap-related communications that we believe may be of interest to you, where you have specifically agreed to this, by email. You can inform us at any time if you no longer wish to receive commercial communications. Alternatively, you can change your preferences in your account settings under the “Receive Newsletters” option, or click the “Unsubscribe” link at the bottom of the service emails to unsubscribe from the newsletter.
- Provide third parties (including other Fichap users) with statistical information about users; this information will not be used to identify any particular individual.
- Handle enquiries and complaints made by you or about you relating to the website.
- Enable Collaborator Users to use the services in a faster and more accurate way through the use of a photograph of their face. This image will be used to enable the system to recognize them, grant access and link them to their profile. In this regard, the Collaborator User gives their express consent to the use of their image and the data that identify them in that image. It is hereby clarified that the data will only be stored for this purpose.
- We will not provide your personal information to any third party for direct marketing purposes without your express consent. Where an order is placed with online payment, at no time does Fichap store credit card data; this is handled by online payment providers such as “Mercado Pago” and/or “PayPal”.
Data visibility
User data will only be visible in the admin Dashboard to the organization that has subscribed to the service and to the person(s) it designates. That organization may only access the users and their corresponding data under its responsibility.
Disclosures and data transfers
We may disclose information about you to any of our employees and agents, to the extent that this is reasonably necessary for the purposes set out in this privacy policy. In addition, we may disclose information about you:
- To the extent that we are required to do so by law.
- In connection with any legal proceedings or prospective legal proceedings.
- To establish, exercise or defend our legal rights (including providing information to others for the purposes of fraud prevention).
Except as provided in this privacy policy, we will not provide your personal information to third parties.
The Company may need to send information to its providers, partners or related companies for the provision of the Service and/or to offer you new services or promotional offers that may be of interest, which may be located outside the country. Owner Users and Collaborator Users give their consent to this and expressly authorize the Company to use their data and transfer such data, where applicable. If required by applicable law, Owner Users and Collaborator Users must sign any additional agreement or amendment that may be necessary to allow data transfers outside the country, in accordance with such applicable laws.
Cookies
A cookie consists of information sent by a web server to a web browser and stored by the browser. The information is then sent back to the server each time the browser requests a page from the server. This enables the server to identify and track the web browser. We will use both session cookies and persistent cookies on the website.

If your information has changed, you are responsible for updating it on the website and/or mobile application or requesting this from your employer and/or Administrator User. This will allow the site to operate correctly.
How to exercise your rights of access, rectification, erasure and objection
It is the responsibility of both Owner Users and Administrator Users to manage and keep Users’ data up to date. Owner Users and/or Administrator Users will have the right of access, rectification and erasure of the Personal Data linked to their Organization, and may make changes to Collaborator Users’ data. To exercise this right, Owner Users and Administrator Users must log in with their registered User ID and Access Key, go to “Company Data” and then “Edit Profile” to modify or delete the data they wish. In order to change Collaborator Users’ data, Owner Users and Administrator Users must go to “Collaborators”, select the Collaborator User, and then click “Edit”. Therefore, the Owner User as well as the Administrator User are responsible for the truthfulness and accuracy of the data, and WORKODE S.A.S. will not be responsible for any inaccuracy in Users’ Personal Data. Users are hereby informed that the deletion of any data may result in the account being blocked or the User being unable to use the Service properly; the User assumes such risk and responsibility.
