This privacy policy establishes the use of "Fichap Mobile," "Fichap Point," "Collaborator Portal," "Fichap Dashboard," and "Fichap Website," created and maintained by Fichap SA (CUIT 30-71616580-5) (the "Company" and/or "Fichap"). We are committed to safeguarding the privacy of visitors to our website, desktop applications, and mobile apps. This policy details how we handle your personal information.

Users and visitors agree to browse the Website and use its content in good faith. Please be advised that:

The data you provide on the Website will be treated with the utmost confidentiality and will become part of the Database owned by the Owner and/or Administrator Users. The Owner User and/or Administrator User are solely responsible for the database, its custody, and its registration, and must comply with applicable personal data protection legislation. It is clarified that the Company only provides such users with a space to store and manage data and their human resources. All data directed to the Company as the recipient will be stored in the database owned by Fichap SA (CUIT 30-71616580-5), located at Av. Libertador 6680, 3rd floor, Autonomous City of Buenos Aires, Argentina, for the purposes detailed below.

You are not obligated to provide your personal data, unless you wish to use the services of the Website or mobile applications, as such data is essential for your identification.

Use of the Service implies acceptance of this privacy policy, as well as authorization for the Company to process the personal data you provide.

You are entitled to exercise your rights to access, rectify, and delete your personal data. To do so, if you are a Collaborator User, you may request this from the organization with which you have an employment or service relationship; if you are an Owner or Administrator User, you may do so from your profile on the Website. By merely visiting the Website, individuals accessing it do not provide any personal information nor are they obligated to provide it. The Company assumes that the data has been entered by the owner or by a person authorized by them, and that it is correct and accurate.

For the purposes of Law 25.326, Fichap SA acts as the controller of the database named “FICHAP,” registered with the Agency for Access to Public Information (AAIP) for Human Resources purposes. Regarding the personal data of Collaborator Users that each Client manages through the Website and mobile application, Fichap acts as a data processor on behalf of said Client (Owner and/or Administrator User), who acts as the controller of such data with respect to their own Collaborators and is responsible for ensuring compliance with the legal obligations corresponding to that role.

What information do we collect?

Information about your computer and mobile device, and about your visits and usage, including your IP address, geographic location, browser type, operating system, referral source to the site and app, session duration, and other data of interest for improving our service.

Information you provide for the purpose of registering on our website and app, including email, first name, last name, city and country of residence, address, phone number, avatar, facial photograph, and login password.

Any other information you choose to send to Fichap.

Information Security Management Objectives

At Fichap, we value the privacy and security of our users. We use facial data exclusively for identity authentication purposes. This process involves:- Facial Data Collection: During authentication, the application captures a facial image of the user, which is compared with a pre-existing profile photo provided by the user's company to verify identity.- Use and Processing: The captured facial image is used solely for this validation purpose and not for any other end. Validation is performed by an algorithm that calculates the matching percentage without storing additional facial data.- Storage and Retention: We do not store facial data after the authentication process. Facial images are processed in real-time and discarded immediately after validation.- Data Sharing: We do not share facial data with third parties. Our policy guarantees the confidentiality and privacy of our users' information.- Data Security and Protection: We implement security measures to protect data processed during identity authentication, ensuring it is handled securely and in accordance with applicable privacy laws.

Using your personal data

Personal data entered on both this website and the mobile app will be used for the purposes specified in these privacy policies or in the relevant sections. We may use your personal information to:

- Administer the website and the app.
- Improve your browsing experience.
- Enable you to use the available services.
- Send you general commercial communications.
- Send you email notifications specifically requested by you.

Send you our newsletter and other Fichap-related communications that we believe will be of interest to you, where you have specifically agreed to this, via email. You can inform us at any time if you do not wish to receive commercial communications. Optionally, you can modify your preferences in your account settings under the "Receive Newsletters" option, or click the "Unsubscribe" link at the bottom of our service emails to unsubscribe from the newsletter.

Provide third parties (including other Fichap users) with statistical information about users; this information will not be used to identify any particular individual.

Deal with inquiries and complaints made by or about you relating to the website.

Enable Collaborating Users to use the services more quickly and accurately through the use of a photograph of their face. This image will be used to allow the system to recognize you, grant you access, and link you to your profile. In this regard, the Collaborating User grants their express consent for the use of their image and the data that identifies them within it. It is clarified that the data will only be stored for this purpose.

We will not provide your personal information to any third party for direct marketing purposes without your express consent. If an order is placed with online payment, Fichap does not store credit card data at any time; this task is handled by online payment providers such as "Mercado Pago" and/or "PayPal".

Data visibility

User data will only be visible in the administration Dashboard by the organization that contracts the service through the person(s) it assigns. Said organization may only access the users and respective data that are under its responsibility.

Disclosures. Data Transfers.

We may disclose information about you to any of our employees or agents, insofar as reasonably necessary for the purposes set out in this privacy policy. In addition, we may disclose information about you:

- To the extent that we are required to do so by law.
- In connection with any legal proceedings or prospective legal proceedings.
- To establish, exercise, or defend our legal rights (including providing information to others for the purposes of fraud prevention).

Except as set forth in this privacy policy, we will not provide your personal information to third parties.

The Company may need to send information to its suppliers, partners, or related companies for the provision of the Service and/or to offer you new services or promotional offers that may be of interest to you, which may be located outside the country. Owner Users and Collaborator Users consent to this and expressly authorize the Company to use their data and carry out the transfer thereof, if applicable. If required by applicable laws, Owner Users and Collaborator Users must sign any additional agreement or amendment that may be required to allow the transfer of data outside the Country, in accordance with such applicable laws.

Cookies

A cookie consists of information sent by a web server to a web browser, and stored by the browser. The information is then sent back to the server each time the browser requests a page from the server. This enables the server to identify and track the web browser. We will use both session cookies and persistent cookies on the website.

The computer hosting the Website uses cookies to improve the service provided by the Company. These cookies are installed automatically on the computer used by Users and visitors, but they do not store any information regarding them.

We will use session cookies to keep track of you while you navigate the site. We will use persistent cookies to enable our website to recognize you when you visit our site. We will retain your personal data for the duration of the contractual relationship with the Client and, once that relationship has ended, for a period of up to ten (10) years to comply with legal obligations and to defend against potential claims, in accordance with Fichap's declaration to the AAIP National Personal Data Base Registry.

We may update this privacy policy from time to time by posting the new version on our website and mobile application. You should check this page occasionally to ensure you agree with any changes. We will also notify you of changes to our privacy policy via email.

Third-party websites

The website contains links to other websites. We are not responsible for the privacy policies or practices of other websites.

Updating information

If your information has changed, you are responsible for updating it on the website and/or mobile application or requesting your employer and/or Administrator User to do so. This ensures the site functions correctly.

Use by minors

The Website, mobile application, and other Fichap Services are intended for use by adults within the scope of the employment, service provision, or commercial relationship the User maintains with the Client. In the event that personal data of a minor is processed through the platform (for example, in the context of family dependents, benefits, or insurance managed by the Client), obtaining the corresponding consent from parents, guardians, or legal representatives, as well as the lawfulness of such processing, is the sole responsibility of the employer and/or the Data Controller and/or Data Processor as applicable in each case, with Fichap being exempt from any liability in this regard.

How to Exercise Your Rights of Access, Rectification, Cancellation, and Opposition?

It is the responsibility of both Owner Users and Administrator Users to manage and keep User data up to date. Owners and/or Administrator Users have the right to access, rectify, and delete Personal Data linked to their Organization, and may make changes to Collaborator User data. To exercise this right, Owner Users and Administrator Users must log in with their registered ID and Password, go to "Company Data," then "Edit Profile," and modify or delete the desired data. To make changes to Collaborator User data, Owners and Administrators must go to "Collaborators," select the Collaborator User, and then click "Edit." Therefore, the Owner User and the Administrator User are responsible for the truthfulness and accuracy of the data, and FICHAP SA will not be held liable for any inaccuracies in Users' Personal Data.

Users are advised that deleting any data may result in account suspension or the inability to use the Service properly, with the User assuming all such risks and responsibilities.

Requests for access, rectification, updating, or deletion of personal data may be sent via email to admin@fichap.com or by mail to our office at Av. Libertador 6680, 3rd floor, Autonomous City of Buenos Aires, Argentina, as declared by Fichap to the Agency for Access to Public Information (AAIP). Such requests will be processed within the timeframes established by articles 14 and 16 of Law 25.326.

If you believe your rights regarding personal data protection have been violated, you have the right to file a complaint with the Agency for Access to Public Information (AAIP), the oversight body for Law 25.326 (www.argentina.gob.ar/aaip).

Additionally, the database named “FICHAP,” intended for Human Resources purposes, is registered under file No. RL-2026-55090627-APN-DNPDP#AAIP.
